Driver License Suspension Rescinded For Driver Who Refused Breathalyzer Test

Recently, a man was stopped in Cook County, IL and accused of driving under the influence. When the police officer asked him to submit to a breath test, the gentleman refused. Subsequently, he was charged with DUI. Since he refused the breathalyzer test, he was facing a 1-year suspension of his driving privileges. The man was distraught over the loss of his license, so he retained DUI attorney Michael O’Meara to review his legal options.
Attorney O’Meara successfully obtained a court order to rescind his suspension because the officers failed to provide him with the proper warnings relating to refusing a breath test. After the suspension was reversed, his client was able to drive again. In addition to his unrestricted ability to drive, his client saved well over $1,000 that he would have needed to pay to drive with an ignition interlock device. This is a device that he would have needed to be installed in his car in order to ensure that he was not drinking and driving.
