Cook Couty Man Avoids 3rd DUI Conviction at Trial
Published: Dec 12, 2016, by in Criminal Defense, DUIRecently, a man in Cook County as pulled over for a suspected DUI. The officer alleged that he detected the strong odor of alcohol from the man’s car as well as observed his bloodshot, glassy eyes and a very flushed face. After assuming he was intoxicated, the officer ordered the man to exit his car numerous times; however, he did not comply, nor did he consent to a breathalyzer test. Once the officer was able to get the individual to obey his repeated commands, the man was charged with his 3rd DUI offense in addition to obstruction of justice. The man was extremely concerned that because of his prior DUI convictions, he’d face grave repercussions including a lengthy jail term and a significant suspension of his driving privileges for refusing the breath test. With hopes of avoiding another DUI conviction, he reached out to the highly-skilled Chicago DUI defense lawyer, Michael O’Meara at O’Meara Law LLC.
Attorney O’Meara knew that his client’s future and in turn his freedom was dependent upon receiving the strongest defense possible. Therefore, he fervently represented his client during a trial, which resulted in the Judge finding him not guilty on all charges. While this outstanding outcome removed the possibility of serving a considerable jail sentence, the man still faced a very long license suspension. This led attorney O’Meara to file a petition to rescind the suspension based on the fact that the officer in question lacked reasonable grounds to believe his client was driving under the influence. In the end, the judge presiding over this matter also agreed with O’Meara’s argument and granted the petition. By choosing quality legal counsel from O’Meara Law, this client not only gained a full reinstatement of his license, but also successfully averted the devastating aftermath of a 3rd DUI.
